1. Our approach
AVERCYN GLOBAL INC ("ShiftKumo", "we", "us") respects the intellectual property rights of others, and we expect our customers and users to do the same. This policy explains how to tell us about material you believe infringes your copyright, how users can respond, and how we handle repeat infringers. We follow the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
To report infringement, e-mail support@shiftkumo.com with the subject "Copyright / DMCA notice" and include the information listed in Section 3.
2. What this policy covers
This policy covers content on our website at shiftkumo.com and content stored in or shared through the ShiftKumo Service, including content that customers and their users put into their workspaces.
3. How to file a copyright notice
If you believe that material available through ShiftKumo infringes a copyright you own or are authorized to represent, send us a written notice. Under 17 U.S.C. § 512(c)(3), your notice must include:
- a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed;
- identification of the copyrighted work claimed to have been infringed or, if a single notice covers multiple works, a representative list of those works;
- identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient for us to locate it (for example, the exact web address);
- information reasonably sufficient for us to contact you, such as your name, address, telephone number and e-mail address;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
A notice that does not substantially include these elements may not be valid, and we may ask you for the missing information.
4. Where to send your notice
Send your notice by e-mail to support@shiftkumo.com with the subject "Copyright / DMCA notice", or by post to:
Copyright noticesAVERCYN GLOBAL INC
1660 LINCOLN STREET, DENVER, CO 80264, USA
E-mail: support@shiftkumo.com
By sending a notice, you agree that a copy of it, including your name and contact details, may be given to the user or customer who provided the material, as described in Section 5. Please send only copyright-related notices to us under this heading. For other questions, use our contact page.
5. What happens after we receive a notice
When we receive a valid notice, we act promptly to remove or disable access to the material identified. Where possible, we notify the user or customer who provided the material, and we include a copy of the notice. We may share your notice, including your contact details, with that user so they can respond.
6. How to file a counter-notice
If material you provided was removed or disabled and you believe this was a mistake or misidentification, you can send us a counter-notice. Under 17 U.S.C. § 512(g)(3), your counter-notice must include:
- your physical or electronic signature;
- identification of the material that has been removed or to which access has been disabled, and the location where it appeared before it was removed or disabled;
- a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.
Send your counter-notice to support@shiftkumo.com with the subject "Copyright / DMCA notice".
7. Restoring material
When we receive a valid counter-notice, we forward a copy to the person who filed the original notice. We restore the removed material, or stop disabling access to it, no less than 10 and no more than 14 business days after we receive the counter-notice. We will not restore it if the original complainant first tells us that they have filed a court action seeking to stop the alleged infringement.
8. Repeat infringers
In appropriate circumstances, we suspend or terminate the accounts of users and customers who are repeat infringers. We may also limit access to the Service, or terminate accounts, of users who infringe the intellectual property rights of others, whether or not there is repeat infringement.
9. Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Before you send a notice or counter-notice, consider whether the use may be authorized or permitted, for example as fair use. If you are unsure, you may wish to consult a lawyer.
10. Notices from outside the United States
We accept notices from rights holders anywhere in the world, including notices under laws other than the DMCA. Please give us the same information listed in Section 3 so that we can review and act on your notice.
